Board Members, Insiders Question Multimillion-Dollar Contract Pushed by Water District CEO

Santa Clara Valley Water District CEO Beau Goldie award contract to firm with inside connections to the water district.

CEO expedites single source contract without a competitive bid process and awards it to a firm with an inside connection to the water district. Tony Kovaleski reports. (Published Friday, Jul 17, 2015)

There are no questions about the severity of California’s drought. Its impact is evident everywhere: brown grass, serious water restrictions and parched reservoirs. But board members and insiders at a South Bay water district question recent decisions made by its CEO to take emergency action and seek approval of a project designed to increase Silicon Valley’s dwindling water supply.

“If it was a normal year we would move down a normal path to address this,” said Beau Goldie, CEO of Santa Clara Valley Water District. “But we are not in a normal year. We don’t know how long this drought is going to last.”

Earlier this year, Goldie expedited a $10 million single source contract without a competitive bidding process, which would have allowed other qualified companies to propose work on the project. The project is intended as a drought solution, but won’t pay water dividends for at least five years.

“Ten million dollars is a lot of money,” said board member Barbara Keegan. “To award contracts without any outside scrutiny, I think it is troubling and that concerned me.”

Keegan voted against the proposal. She, along with board chair Gary Kremen, voiced concern about the single source nature of the contract at an April 28 board meeting.

“I think single-source contracts, unless it’s an absolute emergency like a dam collapsing tomorrow, are a bad idea,” Kremen said in a recent interview with NBC Bay Area. “It shows lack of planning.”

Prior to the meeting, the water district’s director of procurement wrote to staff that the decision to choose the selected firms based on prior knowledge about the district’s master plan is not a strong enough reason on its own. In an April 15 email he wrote, “It will be difficult to argue that these selected firms are the best without any peer comparison or any mention of the criteria for evaluation or selection.”

Yet it was not until after the April board meeting that board members became aware of an inside connection between the district and one of the contract winners, RMC Water and Environment. One of its principal owners is married to an executive staff member at the district who is currently the sixth-highest paid employee in a district with approximately 1,000 staffers.

Public economic interest disclosure forms, show Melanie Richardson, the Deputy Operations Officer for the Watershed Design and Construction Division, has held between $100,000 and $1 million in RMC stock. The forms also show her husband, Tom Richardson, is a principal, paid more than $100,000 a year by RMC.

Both Kremen and Keegan question why Goldie did not disclose that relationship prior to the board’s vote.

“I don’t believe this has been the most transparent process,” Keegan said. “And so if I don’t believe that, it wouldn’t surprise me that there are people within the organization that feel the same way.”

Whistleblowers from inside the water district have reached out to the NBC Bay Area Investigative Unit since April to express concern. “Check recent single source contract done without competitive bidding,” a letter sent to the NBC Bay Area Investigative Unit read. The letter also included, “Wife of key RMC consultant is on leadership team of district” and “Decision not without influence.”

Goldie does not see the relationship as a conflict of interest.

“Looked at it a number of years ago,” Goldie said. “It’s a dead issue. We found that there’s not a conflict.”

He says the district has a “firewall” in place to insulate Richardson from decisions involving RMC, which has received $18 million in contracts with the district since 2004. Goldie also denies that he executed a favor for one of his high-ranking deputies.

“That’s flat out wrong,” Goldie said. “We are not doing a favor for any individual. We are doing work for Silicon Valley as a whole.”

The president of RMC addressed the relationship in a statement provided to NBC Bay Area. “We have always understood that appropriate policies and practices are in place at the district to assure that the highest standards of professional integrity are adhered to in its contracting process, including preventing potential conflicts-of-interest. With regard to the contract in question, the District staff, legal department, and board of directors recommended selection of RMC with full knowledge of RMC’s project manager’s marriage to a District employee,” the statement read.

In a separate emailed statement, Melanie Richardson wrote that she is “not part of any communications that pertain to services being performed now or in the future by RMC.” She continued, “I recognized the potential for conflicts of interest years ago and have done everything I can to avoid true or even perceived conflicts. I truthfully acknowledge my financial relationships in my annual Statement of Economic Interests (Form 700), a public document. I have been extremely diligent in staying clear of any communications or decisions related to the company where my husband works.”

Ultimately, the multimillion-dollar drought solution passed with a 5 to 2 vote. Goldie said he wouldn’t change anything about how he sought board approval. But board chair Gary Kremen has called on the CEO to suspend negotiations with RMC until the conclusion of an external investigation.

“I am going to call on my fellow board members to stop this,” Kremen said.

Goldie said it will take a new vote by the board to halt the current single source contract. Some board members who voted for the drought relief proposal recently told the Investigative Unit they would not change their vote. Others said they join Kremen’s call for an outside investigation.

If you have a tip for the Investigative Unit email theunit@nbcbayarea.com or call 888-996-TIPS.

SUBJECT: Technology Upgrade of the Boardroom (Audio/Visual System)
RECOMMENDED ACTION:
This is an information only item and no action is required.
SUMMARY:
Boardroom audio visual is extensively used for the purpose of Board public meetings, general District and
community events that are business, educational, outreach or celebratory in nature, and by District’s
departments, divisions and units for various group meetings. The system uses dated technology that does not (only the racks and amplifiers are from 2000, they will never change and the equipment is solid state digital until output.)
meet the current digital and high definition broadcasting standards. ( most viewers in the US still have dial up and the ones the don’t have at best 1.5mb if that, is not equipment, do a test, vieW a meeting and try different bandwidths, IT knows this!) Hd is not always the right choice!)
Staff( OR GEORGE HAS PROVIDED ALL INPUT AND WISH LIST FOR THE CONSULTANT) has performed extensive additional review of the system along with a stakeholder input. In order to
comply with the latest high definition broadcast standards, and features, staff recommends a major technology
upgrade of the audio visual system in the Boardroom. The estimated project cost, including design,
construction, staff labor, and contingency is $600,000.( wrong they have already wasted over 40k in unused gear, (BTW NO AV COMPANY COVERS CONDUIT, ELECTRICAL, PLASTER, DRILLING WHICH IS MORE COST) AND A WASTE OF MINE AND YOUR TAX DOLLARS. ETC. ETC. UNDOCUMENTED STAFF TIME, (ASK TO SEE THE AV WAREHOUSE, THE GEAR SITS< THE COMMITTEE MEETING SPEAKER/MICS/REQUEST GEAR, THERE IS NOTHING WRONG WITH THAT, BEST THERE IS BEYER, unused prs, and untold staff hours, and cannot do hd and wiring for this cost, this will go past 1.5 mil, just look at every av job from day one) or ask!!   THE ORIGINAL SYSTEM( AND AUDIT 2012 EXPLAINS HOW MANAGEMENT WORKS) COST 2-3 MILLION NEVER COULD GET RIGHT ANSWER, WENT TO GRAND JURY. THAT SAID THEY WORK THE SAME WAY TODAY.  WE HAD YEARS OF CLASSES TO GET ALONG WITH MANAGEMENT, BUT 500K RAISE TO BEAU, LEFT NO ROOM FOR THAT DEPARTMENT.  BUT NO CHANGE, STILL TO THIS DAY, SAME MANAGEMENT SHENANIGANS FOR ME, AND OTHERS REMAIN TO THIS DAY IN THE DEPT.

DiversityAudit2012 READ THE ENCLOSED AUDIT, ITS TRUE.  IT WAS SO MESSED UP THEY HIRED ME, THAT SAID, EVERYTHING HAS BEEN REPLACED, MODIFIED, UPGRADED, DIGITAL, VIRTUAL, REMOTE CONTROL, SPLIT SCREENS, MULTIPLE ROUTING ANYWHERE IN BUILDING, VIA WIRING OR CAT 5/6 WHICH IT KNOWS AND THIS IS THE WAY TO WIRE NOW, DIGITAL RECORDING AND AUDIO AND OR VHS, HARD DRIVE AND OR CD/DVD, OVER EAR MICROPHONES, VOICE TRANSMITTED INTO DIRECTORS HEARING AID, IN EAR MONITORING, VIDEO CONFERENCING,  CABLE TV TO MOST OF CAMPUS, TO OUTER BUILDING CABLE IS RAN JUST NEED EQUIPMENT FOR FAR END!, CAMERA FOLLOW USER, AND CENTRAL PANEL AND MULTI CAMERA CONTROLLABLE TO GIVE EVEN MORE CAMERA CONTROL WAS PAID FOR AND PROGRAMMING, BUT LIKE OTHER EQUIPMENT SITS AS GEORGE ORDERED WORK TO STOP SO THE SYSTEM WILL FAIL.   CONTROL ANYWHERE IN THE WORLD, USER HAVE CONTROL SYSTEMS TO REQUEST TO SPEAK, ON/OFF MICROPHONE, AND VOTING CAN BE ADDED TO THOSE SAME SCREENS, EVEN AUDIO, IF TURNED ON, AND MUCH MORE, 10K IN FEW MODERO PANELS FOR CHAIR, TECH, COB, AND LED DISPLAY OR ROUTE TO SCREENS, AND THIS IS NOT ALL.  EQUIPMENT IS AT OLDEST 2004 BUT ALL STATE OF ART, AND BEST USE OF TECHNOLOGY, AND MY AND YOUR TAX DOLLAR, THIS ROOM HAS MORE BELLS THEN HIGHER GOVT ROOMS.
The primary objectives for the technology upgrade are as follows:
A. Improve the Boardroom experience for the public by implementing a state-of-the-art audio visual, WE CA ADD LIGHTING, SMOKE, AND OTHER ENHANCEMENTS CONTROLLED AND RUN BY THE CONTROL SYSTEM, DEPENDING  ON DEFINITION OF WHAT YOU WANT A MINOR MASTER UPGRADE MIGHT NEED TO HAPPEN.   LESS THAN 10K.

B. Create a high quality, user-friendly AV system with enhanced capabilities for person(s) with disabilities.( already is state of art uhf assisted listening, and the best screen resolution @1024×768 hd will make it harder to see)

D. The system should be able to support an electronic voting (e-voting) system (Upon approval by the
Board) in the near future.  WE HAVE ALREADY DEMO’D AND GEORGE HAS THE REQUIRED AMX UPGRADE EMAIL, PRETTY SURE RAY DOES ALSO.
E. Implement an end-to-end system that complies with the latest standards of high definition broadcast.  (THEN WHAT WILL VIEWERS DO WITH THERE SMALLER FONT AND SMALLER/WIDER SCREEN?  HAVE YOU ASKED THE PUBLIC, NOT JUST STAFF)
F. Based upon the stakeholder review, incorporate new features and enhancements to improve the
experience of a Boardroom event.  LIGHTING, SMOKE, SUB WOOFERS CAN EASILY BE ADDED, HOWEVER, YOU MAY WANT TO TAKE A LOOK AT THE ROOM, ITS NOT A BOARD ROOM BUT A CHURCH, YOU WILL NEVER BE EITHER HAPPY OR HAVE AS GOOD OF GEAR AS YOU DO NOW, THE BOARDROOM IS EVEN ON THE SAME NETWORK AND EQUIPMENT IN CONNECTED ROOM ALL COMMUNICATE TOGETHER, SO DON’T FORGET THOSE ROOMS WILL NEED CHANGING ALSO, OR SOME OF THE GEAR.
BACKGROUND:
The current audio visual system was designed in 1997 and built in 2000. The core and the functionality of the ( WHAT IS SAD IS ONLY THE RACKS AND AMPLIFIERS OR SOME ARE ORIGINAL, BUT THEY ALSO ARE DIGITAL CORE AND THE OUTPUT WILL ALWAYS BE ANALOG. The technology is obsolete, and very hard to support and maintain on a regular basis. The reliability of this outdated ( ONLY BECAUSE GK ORDERED WORK TO STOP AND THERE IS EMAIL TO THIS, ALL EQUIPMENT PURCHASED SITS)
system is unpredictable, and on many occasions it has experienced failures. Such failures sometimes ( HOW CAN IT BE HARD TO SUPPORT WHEN OVER 25 LOCAL COMPANY S WILL GLADLY WORK THERE FOR ISSUES/PROBLEM, I’M ALWAYS AVAILABLE FOR HELP, AND GLADLY HELP) ASK GEORGE WHY HE STOPPED MAINTENANCE?
have resulted in expensive repair costs, and potential delays in bringing the system online for the meetings.  (They have spent no more than 10K sense i left, they want the system to fail) plus 1000s of dollars in new gear just sits.)
Another challenge Finding professional support for the existing system by mainstream vendors and
manufacturers is also very challenging. The components of the system also do not meet the latest ENERGY
STAR rating standards. ( THIS IS FOR WASHING MACHINE ETC, ANY ENGINEER KNOWS AV EQUIPMENT DOES NOT REQUIRE THIS AS THEY ARE SOLID STATE, THEY HAD TO DIG DEEP FOR THIS)  iF IT WAS NOT PUT IN WHAT WAS A BATHROOM A LOCATED BEHIND AV AND AMX CONTROL GEAR BOUGHT AND, SITS TO CONTROL GEAR BETTER, JUST SITS.
The new system will enhance transparency as recommended in the recent audit. It will also provide a better (EVERYTHING IS ALREADY TRANSPARENT UNLESS YOU DO NOT POST IT. ONLINE, BACK UP DIGITAL TAPES, AUDIO, 6 CAMERA ANGLES ETC.)

I put over 100k in new gear in there from 2000 on, look in the store room untouched equipment, the conflict is ravi, george Kamenjati no nothings, the tech is not 16yrs old just wanting to sell equipment, and no oversight, its a church in there not a board room. the golden place is just that a pit.

AGAIN WHAT IS SO HARD ABOUT WRITING ME BACK, A RETIRED EMPLOYEE,  AGAIN WHERE ARE MY THINGS SCVWD OR GEORGE TOSSED OUT, THAT DAVID AND I AGREED ON A AMOUNT ALREADY.  ITS FINE WHEN THE BOARD ROOM COMMITTEE CONNIVES, THEY WILL HEAR AND SEE ALL THE PO’S OF WASTE AND MORE MANIPULATION BY FRANK AND GEORGE.   NOT TO MENTION EVEN MORE PROOF WILL COME OUT FROM THE COMMITTEE.   FROM OLGA THROUGH JESUS YOU JUST PROTECT YOUR OWN, READ THE DOCUMENTS SUBMITTED BY MYSELF AND OTHERS.  AND THERE IS MANY MORE, MORE THAN YOU WILL WANT TO SEE i WILL NOT REST UNTIL JUSTICE IS SERVED! AND I OFFERED YOU AN EASY WAY OUT NOW IT WILL GET BLOWN ALL OVER THE PUBLIC.

AGAIN THE AUDIT 2012 IS BELOW, SHOW’S THE SAME ACTIONS STILL GOING ON TODAY, BOTH THE TECH STATEMENT AND MORE PROOF OF GK MANIPULATIONS AND MINE FROM THE BOARD MEETING YOU REQUESTED MONEY TO REBUILD THE BR!   DOES THE PRESS KNOW THAT YOU ARE ON HOW MANY FIRED CIO IN HOW MANY YEARS?, WHY HAS NO ONE TOLD THE NEW CIO THE REAL TRUTH.
LOOK I JUST WANT THE FUNDS PROMISED ME,  AND ALSO TO SETTLE THE DISPUTE OF GEORGE KAMENJATI.   AND AS DAVID SAID SUPPLY ME WITH NAMES AND WE WILL INTERVIEW THEM, WELL ITS BEEN OVER 8 MONTHS, WILL WE WAIT UNTIL THE NEW BOARDROOM OVERSIGHT COMMITTEE MEETS, THEY WILL GET ALL RECORDS.  NOT ONE PERSON HAS REACHED OUT TO LISTEN TO ME AND ONLY SPEAKS TO THE GUILTY. ALSO WHAT HAS BECOME OF THE STATEMENT I HAVE TO PASS THIS ON TO ANNA NORIEGA, SHE HAS NOT INTERVIEWED ANY OF THE WITNESSES EITHER.   WHY ASK ME FOR NAMES OF PEOPLE TO INTERVIEW AND NOTHING HAPPENS??  SEE NOW CITIZEN ARE STANDING UP LIKE MR. MUIRHEAD QUESTIONING THE MILLIONS IN IT MONEY, AND OTHER FUNDS AT THE DISTRICT, LIKE HIDING THE IT BUDGET IN CAPITOL PROJECTS??
I WOULD LIKE WHAT WAS PROMISED, I WOULD LIKE YOU TO SEE WHY YOUR MANAGERS MANIPULATE , AND BRING AN END TO THIS MESS.
again lets close this out please.
Or  we can address the board and the new boardroom committee, when that connives.

Paul:

Thanks for the email.  I spoke with several people in the IT unit, and it looks like they might have inadvertently thrown some of your things away.  That was the basis of the $1,300 offer.  In my discussions, it became clear to me that nothing was intentional, and that they were just trying to clear and clean.  As for the other issues, I can’t find any evidence of your manager breaching any confidentiality or intentionally telling someone about your medical condition.

The $1,300 offer still stands.  If you would like to accept the offer, please let me know.

So my personal items, the amount is fair, however what about the said manager telling false, misleading and my medical information to other scvwd workers?
I think or am very sure if you ask IT employee’s and other departments i worked for you will find the said manager guilty of the issue i sent in.  And this is also a larger issue with middle managers per audit 2012, and other lawsuits.

I will give my answer upon hearing about that also??
thank you

MISSING FROM BOXES, (MISSING BELOW ). a statement you have seen but no one listens too.
read over the list OF my stuff missing, notes as to what is still there, or as you will see you sent lots of district items(taxpayers) and kept a few of mine things still. also note the enclosed email ray had sent before about surplussed and tossed items, i can provide other witnesses if you desire. I plan to be in the area and can point out m” I been out a few days and busy, I had a couple of more items to add to his stuff. I wanted to comment on the emails that Paul has been sending. I gave Frank a copy of things surplus, missing etc and told him verbally a y things?
gk would not help and this was only time i was allowed in, they knew my back was messed up yet wanted me to do all this?????

couple of times.

In addition I mentioned to Frank that George wanted us to surplus and Mike T told Frank as well that George said to toss anything that is not district related. All this was known to Frank BEFORE Frank sent a email to Paul saying NO ONE tossed out or surplus your items, that is not true, because I personally told Paul that I surplus his case since I did not know it was his ( also why would you have a temp surplus or say toss stuff out??), I told that to Paul last year. Why then, does Frank send a email to Paul when he had a list and full knowledge from me telling him verbally prior??
George and Frank themselves came in to box Paul?s cube, and as you know Frank and George were supposed to meet with Paul that very first time , but Frank called in and George stayed in his cube even after me calling him to let him know Paul was here, and George did not even acknowledge me when I went to his cube. There was security here as we know when Paul came that day, so no reason George could not have came out to help and get him moving along. So what I am saying is, what Paul has been emailing is a lot of truth behind it, as I Know all too well how they been treating both of us as I am in a big mess with them. I been silent, but I am also involved as directed by Frank to get his stuff, so I wanted to chime in.
anyone in it can verify i had from day one 90% of my gear there.

I also have taxpayer bought software you sent, manuals of district equipment, that tax payers paid for???, batteries that were part of the recycle(rechargeable) battery program i started, and charger at least 200 lbs of magazines that the taxpayer should not have had to pay shipping for???

being i was not allowed back, i could have shown you my things. i was retired medically, but the real conspiracy was from Ravi, george and frank, who did not want me showing to truth about the board room system, nor was i able to gather my personal items, which many things got tossed, stolen or @ someones house. emails with dates, legal papers, names of employee’s will to tell all can all be provided.

missing personal item’s Was not allowed back into building when i was retired. Items have been tossed out, surplused or stolen. Some items taken for home use. this list is in no way complete, i was out due to back pain for around a yr, so this is just major missing things, i should add a misc 1000$ to cover other missing items.

I will drop the upcoming lawsuit and personal injury(small claims) against scvwd, george kamenjati, frank fung, ceo, cao, hr and ethics for all there non response, to upper management and IT for disclosing my medical and personnel information and more to workers at scvwd, there is more than just one witness to this and lots of proof, as you may know. read audit 2012 about upper management and staff, about how things are run. I have scvwd personal to back this up, emails, dr kamenjatis web site on bi polar, ruining my good name, forcing me to endure more pain and suffering, while dealing with on issue’s. I trust as you might know when legal get’s involved it will cost 5 times as much. It would not be going this far had you not covered up for middle management. I will move on, you can waste tax money on another boardroom as you will never get it right.
why is scvwd responsible, read the audit 2012, you did not allow me into the buildings, you covered up what your middle managers are doing wrong. Why are you on yet another IT unit head, as the audit 2012 states you have very big issue’s.
Would you like to see all the emails, videos, and other documents that have been copied during the last 12yrs.
